Regulations for the Use of Library Materials and Services

CHAPTER I. GENERAL PROVISIONS

  1. The Regulations on the use of materials and services, hereinafter referred to as the “Regulations”, specify the terms and conditions for the use of materials and services of the Municipal-District Library
    in Kwidzyn together with its library points, hereinafter referred to as the “Library”.
  2. The provisions of the Regulations apply to all Users and Guests using the Library’s materials and services.
  3. Each User should read the Regulations and comply with their provisions.
  4. The User submits a declaration of having read the Regulations on the commitment card.
  5. The library is a public cultural institution operating on the basis of:
  • Act of 27 June 1997 on libraries (Journal of Laws No. 85, item 539, as amended),
  • Act of 25 October 1991 on organizing and conducting cultural activities (Journal of Laws No. 114 item 493, as amended),
  • Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws No. 133,883, 
    as amended),
  • Act of 4 February 1994 on copyright and related rights
    (Journal of Laws No. 24 item 83, as amended),
  • statute of the Municipal-District Library in Kwidzyn.
  1. The personal data controller is the Kwidzyn Municipal-County Library, Kościuszki 54, 05-500 Kwidzyn. The Library Director acts on behalf of the Data Controller.
  2. User data will be used to ensure the protection of available and loaned collections, to pursue potential legal claims, and to maintain statistics regarding Library use. The Library is authorized to process User data under the Act of 27 June 1997 on Libraries (Journal of Laws No. 85 item 39, as amended). The Library is obligated to process information about socio-professional groups under the Act of 29 June 1995 on Public Statistics (Journal of Laws 1996, No. 88 item 439, as amended).
  3. The User has the right to access, update, limit processing, transfer their data and object to further processing.
  4. In case of disputes, the User has the right to lodge a complaint with the supervisory authority. The Data Protection Supervisor provides clarification on matters related to personal data
    .
  5. Whenever the Regulations refer to:
    1. library materials – this means documents containing a recorded expression of human thought, intended for dissemination, regardless of the physical medium and the method of recording the content, i.e.: books, magazines, films, audiobooks, electronic collections available online, board games, as well as e-book readers and e-readers.
    2. commitment card – this means a document containing:
  • User’s personal data (surname and first names, date of birth, registered and residential address with code, PESEL number, telephone number, e-mail address)
    as well as User number and statistical code specifying the socio-professional group,
  • Data Administrator details,
  • the User’s declaration that he/she has read the Library Regulations and undertakes to comply with them and to be liable for any damage caused,
  1. library card – this means a document prepared on the basis of a commitment card and registered in the library computer program enabling borrowing and using library services.
  2. user – this means a person who has met the conditions entitling him/her, in accordance with the Regulations, to use library materials and services, has accepted and undertaken to comply with the Library Regulations by making a declaration on the commitment card and has completed the library commitment card.
  3. guest – this means a person who does not have a library card and who uses the Library premises (independent study, work).
  4. Identification document – this means an ID card, driver’s license, or student ID confirming the identity of the person applying for use of the Library’s materials and services. The basic data contained in such a document include: the person’s surname and first names, date of birth, and PESEL number. Foreigners must present a passport or residence card.


CHAPTER II. LIBRARY MATERIALS

  1. The Library collects and provides access to the following library materials: graphic documents: monographs (books) and periodicals (newspapers, magazines); audio documents (audiobooks), e-books; audiovisual documents (DVD films and others); electronic documents (multimedia publications, databases and computer programs); other (board games, e-book readers, e-readers).
  2. Library materials are the property of the Library.
  3. The condition and status (available/borrowed) of library materials are presented in the electronic catalogue available in the Library and via the Library website.
  4. Library materials are available through free access to shelves or through a librarian.

CHAPTER III. RIGHT TO USE THE LIBRARY

  1. The right to use the Library is universal under the terms set out in the Act on Libraries and these Regulations.
  2. Borrowing library materials and using computer equipment is free of charge.
  3. To join the Library you must:
  4. show an ID with a photo and PESEL number and provide your current residential address
  5. read the content of these Regulations and commit to complying with them by signing the commitment card,
  6. Minor Users (under 13 years of age) must be registered by their parent or legal guardian, who signs the commitment card on their behalf as the authorized person. Registration is based on a temporary ID card or school ID.
  7. The fee for issuing the first library card and the next one in the event of its loss is regulated by Annex No. 1 to the Regulations.
  8. The user is obliged to inform the Library about any changes in his/her data: place of residence, registered address, telephone number, e-mail address, and name.
  9. The Library updates user data on an ongoing basis. Upon changing their name, users are required to resubmit the declaration on the obligation card.

CHAPTER IV. RIGHTS AND OBLIGATIONS OF USERS AND GUESTS OF THE LIBRARY

  1. The user has the right to:
  2. borrowing library materials under the conditions specified in the Regulations
  3. using the help and advice of a librarian, including when selecting library materials
  4. The guest has the right to use the Library premises (independent study, work).
  5. When using library materials and services, the User must always present his/her library card.
  6. The user is fully responsible for the actions or omissions of persons using his or her library card.
  7. The following applies on the Library premises:
  8. a ban on smoking tobacco, cigarettes, e-cigarettes, substances and devices containing nicotine, taking drugs and other intoxicating substances, drinking alcohol and eating and drinking drinks (in justified cases, e.g. illness, eating and drinking drinks may only take place in a designated place),
  9. People whose condition indicates the consumption of alcohol or other substances, or lack of personal hygiene, are not permitted in the Library. Persons who pose a threat to the safety of other users are also prohibited from staying in the Library.
  10. when a contagious disease is present at the User’s home, he or she cannot use the Library,
  11. Behaviour that is disruptive to other users and disrupts the provision of library services is prohibited, including conducting loud conversations, playing personal players at high volume and using mobile phones,
  12. any actions that cause damage to library materials while reading are prohibited (e.g. underlining text, placing books upside down, etc.),
  13. The librarian has the right to ask a User who does not comply with the rules of social coexistence to leave.
  14. The user is obliged to:
  15. comply with the rules for using library materials and services specified in the Regulations,
  16. take care of the library materials entrusted to them, in particular protect them against loss, mechanical damage or dirt,
  17. do not share library materials with other people
  18. protect the library card against loss or destruction, immediately notify the Library of its loss, and inform about changes to the personal data included in the commitment card,
  19. present your ID document each time the librarian requests it to check the data against the data provided in the commitment card.

CHAPTER V. RULES FOR PROVIDING LIBRARY MATERIALS

  1. The user can borrow a total of 10 copies of library materials at one time, across all departments:
  • books,
  • e-books,
  • audiobooks,
  • films,
  • magazines,
  • e-book readers (maximum 1 pc.),
  • readers (maximum 1 pc.),
  • board games (maximum 2 pcs.)
  1. The e-book reader is only lent to Users aged 13 and over.
  2. The user who rents an e-book reader with accessories (case and charger) is obliged to return it without the uploaded files.
  3. A user who borrows a reader with accessories (a charger and a CD card with pre-loaded audiobook files) is obliged to return it with the complete card.
  4. The library offers e-books and audiobooks on the Legimi service. Library cardholders can visit the library in person and receive a code valid for one month. Details on using Legimi can be found in the “Regulations for accessing the Legimi book collection” on the Library’s website.
  5. The user borrows library materials for 30 days.
  6. The user may extend the loan period of library materials before the return deadline (except for e-book readers) by the following dates:
  • for another 30 days up to 3 times through the librarian  
  • for another 14 days (maximum twice) using the extension option from the reader’s personal account, provided that the User has met the criteria presented in chapter V, points 7-10.
  1. The User may extend the e-book reader once for one month, provided that another User has not ordered the reader in the Library’s library system and the extension took place before the return deadline.
  2. The librarian may extend the deadline for returning library materials if the library material has not been reserved by another user.
  3. The extension can be made in person, by phone or by email by contacting the facility where the User borrowed the items.
  4. If the User is keeping borrowed items, the librarian may limit the number of borrowed items to two.
  5. The user cannot extend the materials after the return deadline if this deadline exceeds 14 days.
  6. In exceptional cases, the librarian may consent to the loan of a larger number of library materials.
  7. Users can reserve library materials in person, by telephone or via the online catalogue.
  8. Reserved library materials must be collected by the user within 3 days. Once the material is ready for collection, the Sowa library system automatically sends an email informing about the collection. After this time, uncollected materials are transferred to the next holder of the reservation or placed on the shelf.
  9. A user who rents a board game receives a set of pieces that are counted when returning the game.
  10. The user may use the book collection on site, current periodicals as well as periodicals kept in storage only in the Academic Lending Reading Room.
  11. Users may borrow back issues of periodicals for a period of 14 days after placing an order with a librarian. Orders will be fulfilled
    the day following the order date.
  12. Users can take advantage of inter-library loans made
    at the Academic Lending Desk with a press reading room.
  13. The User pays a fee to cover the costs associated with fulfilling the order for library materials, according to the shipping price list. The fee will not be refunded for library materials ordered but not collected by the User.

CHAPTER VI. PROCEDURE IN THE EVENT OF DELAY OR FAILURE TO RETURN LIBRARY MATERIALS, THEIR LOSS, DESTRUCTION OR DAMAGED

  1. Users are responsible for the timely return of borrowed library materials and the timely receipt of reservations and orders. The library is not obligated to remind library materials by phone or email about their due date.
  2. In the event of a delay in returning borrowed library materials by the User beyond the agreed deadline, a detention fee specified in Annex 1 to the Regulations shall be charged.
  3. The Library sends a reminder to the User to return the borrowed materials and pay the fine.
  4. The user covers the costs of summonses sent to him/her (the cost of a postage stamp or registered mail with acknowledgment of receipt), which
    are added to the debt resulting from the overdue library materials.

  5. The Library suspends the use of library materials until the arrears are settled .
  6. The Library reserves the right to pursue its claims in court against Users who refuse to return borrowed library materials and who have not settled outstanding debts, including debt collection costs.
  7. In special cases, the Library may waive enforcement of the regulatory penalty. The decision rests with the Library Director.
  8. In the event of loss or destruction of library materials, the User is obliged to:
    a. repurchase the same title,
    b. repurchase another item useful to the Library (agreed with the librarian) of the same or higher value,
    c. pay an amount not less than the current market price of the damaged/lost library material,
  9. In justified cases of force majeure (e.g., theft, fire), the Library may waive the right to pursue claims against the User under this section. Decisions are made by the Library Director.

CHAPTER VII. RULES FOR USING LIBRARY SERVICES

  1. The Library provides free use of computer equipment to Users.
  2. The User and Guest have the right to use their own computer equipment and digital camera.
  3. Only a User with a library card may:
    use the Library’s computer equipment and access the Internet,
    b. borrow headphones for working at a computer.
  4. Guests can use the Internet access on their own equipment.
  5. Users are required to:
    notify the librarian when using a computer, borrow headphones, and present their library card. Equipment is loaned for the duration of its use.
    b. Computer use is limited to one hour.
  6. In justified cases, the librarian may grant more time to use the computer, provided there are no other users waiting for access to the computer.
  7. The use of databases, multimedia collections, Internet resources and any information and bibliographic services may not be carried out in violation of the provisions of the Copyright and Related Rights Act.
  8. The possibility of copying data onto your own media is permitted only in compliance with the provisions contained in point 7 of Chapter VII.
  9. Users are prohibited from:
  1. installing additional software,
  2. using personal settings and preferences, including the use of passwords and codes,
  3. actions causing destruction or damage to computers and their equipment, disorganization of the computer network and destruction of software,
  4. making any changes to the configuration of computers, attempting to break existing system security measures or interfering with the content of collected data,
  5. Using the internet to commit illegal acts, such as those violating copyright law, accessing websites containing pornography or graphic scenes, or promoting violence. Internet access may also not be used to view and distribute offensive materials or social networking sites intended solely for entertainment (games, instant messaging, dating).
  6. sending mass mailings and large attachments, as well as other activities that disrupt network operation,
  7. moving to different computer stations multiple times a day without notifying the librarian about the need to extend working hours.
  1. In the event of technical problems with a computer, the User is required to notify the librarian. Users are prohibited from attempting to repair damaged computer equipment.
  2. Content saved by the User on the computer is deleted when the computer is closed.
  3. The user acknowledges and accepts that his/her work may be monitored at any time by the librarian (or other persons authorized by the Library Director).
  4. Librarians have the right to monitor the activities performed by Users and Guests on the computers and to immediately terminate the session if they believe that the User or Guest is performing undesirable activities, even if they are not covered by the Regulations.
  5. The User and Guest have the right – within the limits set by copyright law and solely for private use – to make computer printouts and scans.
  6. Fees for photocopying services are specified in Annex 1 to these Regulations.
  7. Photocopying services are available in the Academic Lending and Press Reading Room, subject to librarian availability. Printing is also available in the Adult Lending Room.
  8. Copying library materials is permitted only within the limits permitted by the Copyright and Related Rights Act.
  9. The library offers access to a Playstation and VR2 goggles – for use on-site at the Multicentrum.

CHAPTER VIII. RULES FOR USING THE LIBRARY’S CULTURAL AND EDUCATIONAL OFFER

  1. During classes conducted as part of the cultural offer, Participants are subordinate to the class leaders and Library staff.
  2. Users attending classes held in the Library are required to leave their outerwear in a designated place or in the cloakroom.
  3. Adults are not allowed to participate in classes within the offer intended for children and young people (this does not apply to parents or legal guardians if the child’s age does not allow them to participate in the classes independently).
  4. Parents are not permitted to leave children under 7 years of age unattended in the Library. Library facilities are not intended or authorized to provide childcare, including providing food and drink, or care in the event of a child’s sudden illness or ill health.
  5. As part of the offer, Library Users can use board games, multimedia games and other devices and materials after prior arrangement with a Library employee.
  6. In justified cases, the Library has the right to cancel classes.
  7. The range of classes and events is available on the Library website.

CHAPTER IX. FINAL PROVISIONS

  1. Information regarding the Library’s opening hours is posted in a visible place on the Library premises and on the Library’s bulletin board website.
  2. The Library is not responsible for items left by the User in the Library.
  3. Complaints and requests are accepted by the Library Director every Wednesday from
    12:00 a.m. to 12:00 p.m. and from 3:00 p.m. to 4:00 p.m. Appointments must be made in advance by phone at 055-279 33 50 ext. 2.
  4. Any user who fails to comply with these Regulations may be temporarily banned from using the Library and its services, or, in the case of particularly egregious violations, permanently. The decision in this matter rests with the Library Director.
  5. In matters not regulated in these Regulations, the provisions of the Civil Code shall apply.
  6. The amount of fees and penalties is regulated by Annex 1 to these Regulations.
  7. The regulations are effective from 15 July 2024.

 

Appendix No. 1 to the Regulations on the use of materials and services of the Municipal-District Library in Kwidzyn

 

Price list of fees charged by the Library:

  1. The following prices are set for photocopying services from books, computers and other materials:

    – copy/print/scan/black and white A4 – PLN 0.30
    – copy/print/scan/color A4 – PLN 0.40
  1. Fines for late returns of library materials:
    – for one copy (book, audiobook, e-book) – PLN 0.10 per day
    – for one copy of a film, board game – PLN 0.50 per day
    – for one e-book reader, e-reader – PLN 1.00 per day
  2. For a request sent by post to the User, the Library charges a fee in the amount of (the cost of a postage stamp or registered mail with acknowledgment of receipt).
  3. There is no fee for issuing the first library card for a reader under 13 years of age.
  4. The fee for issuing the first library card for a reader over 13 years of age is PLN 2.
  5. The fee for issuing another library card is PLN 5.00.
  6. Shipping costs for library materials imported through interlibrary loans – according to the shipping price list.
  7. Persons with a “Large Family Card” are exempt from fees for issuing the first library card.
  8. The user receives a receipt for payment.
